The Services are owned and operated by Century Ventures Capital Sdn. Bhd. (Company Registration Number: 765601-H) ("we", "us", or "our"). By accessing or using our Services, you agree to be bound by these Terms.
1. Services Provided
360 Marketing provides an integrated phygital marketing ecosystem, which includes but is not limited to offline distribution (Flyers Media), omnichannel attribution tracking (GoWhere Business), WhatsApp/SMS communication tools (360connect), and gamified marketing systems. We reserve the right to modify, suspend, or discontinue any part of the Services at any time.
2. Acceptable Use and Compliance
When using our communication infrastructures (such as WhatsApp APIs and SMS gateways), you represent and warrant that you will comply with all applicable laws, including the Malaysian Communications and Multimedia Act 1998 and the Personal Data Protection Act 2010 (PDPA). You agree NOT to use our Services to send spam, unsolicited promotions, or any illegal, abusive, or harmful content. We reserve the right to suspend accounts that violate these guidelines without prior notice.
3. Innovation Fund and Credits
Any marketing credits, subsidies, or "Innovation Fund" offers promoted on our platform are subject to application approval, availability, and specific campaign criteria set by Century Ventures Capital Sdn. Bhd. These credits are non-transferable and cannot be exchanged for cash.
4. Intellectual Property
All content, designs, algorithms, tracking infrastructure, and methodologies presented on this website are the exclusive intellectual property of Century Ventures Capital Sdn. Bhd. You may not reproduce, reverse-engineer, or distribute any part of our platform without explicit written permission.
5. Limitation of Liability
To the maximum extent permitted by law, Century Ventures Capital Sdn. Bhd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; or (ii) the success, ROI, or outcomes of any marketing campaigns executed through our platform.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
